Hit-and-run suspect was deported 15 times in 15 years

An oft-deported Mexican citizen accused of driving drunk and fleeing the scene after blowing through a stop sign and crashing his truck into a auto, seriously injuring a 6-year-old boy, pleaded not guilty Wednesday to felony charges.

As a result of the crash, Benjamin's son Lennox suffered a major head injury and was taken to the hospital immediately.

The boy was returning home from a trip to Disneyland.

A family made up of a mother, father and their six-year-old son were going home from a trip to Disneyland when, according to the survivors' family, a man in a pickup truck smashed into their vehicle and sped off, CNN reports.

Police said Banda left the scene, but was taken into custody a short time later by Border Patrol officers.

Banda has been deported from the United States more than 15 times since 2002.

Lennox's family, inclduing his parents who suffered minor injuries in the collision, are cautiously optimistic about his prognosis.

The Lakes made the long drive from Anaheim and just one block from their San Ysidro home, police say Banda Acosta slammed into the side of their auto where Lennox was strapped in his vehicle seat.

Banda-Acosta pleaded not guilty in Chula Vista Superior Court to three felony charges of driving under the influence of alcohol, driving with a blood-alcohol level of more than 0.08 percent, hit-and-run, and a misdemeanor charge of driving without a license.

Banda-Acosta's wife said he had been deported from the USA around January 10, but stayed in Mexico for only 10 days before returning to the U.S.

His bail was set at $230,000.

He faces seven years and eight months in prison if convicted, said Deputy District Attorney Christopher Chandler.

He is also in trouble with Immigration and Customs Enforcement (ICE), once again. She said she's trying to get a protective order against him. "His scalp has a laceration on it that required six stitches", Lake, who struggled to hold back tears, told KGTV.

Lake said his son's eyes were swollen shut until Tuesday night, when he was able to open them again. "[I hope] justice does their job and things work out the right way", Ben Lake said.

His now estranged wife told me he was deported January 10th but made his way back January 20th.
